Tier 2 Sponsorship
If the sponsor cannot pay the salaries of sponsored employees because they have temporarily reduced or ceased trading then they can reduce temporarily reduce the pay of the sponsored employees to 80% of their salary or £2,500 per month, whichever is the lower. Any reductions must be part of a company-wide policy to avoid redundancies and in which all workers are treated the same.These reductions must be temporary, and the employee’s pay must return to at least previous levels once these arrangements have ended. My advice would be to report this.
They can be furloughed but the period in which they are furloughed will not count towards the 12 months period required for job creation.
There is no guidance published by the Home Office for these individuals. However as there is no salary requirement for such employees, I assume there salary can be reduced and therefore they can be furloughed. Evidence to explain why this was required should be supported.
